The recent 338 page report from Special Counsel Robert Hur on President Biden’s alleged retention of classified documents as a civilian says more about the justice system and the farcical nature of the elections than it does about any real legal concern. Hur’s language in the report has been fuel for the scandal mongering and sensationalism of the 2024 election, spurring both Democrats and Republicans to latch on to the phrase “an elderly man with a poor memory” with which Hur describes not the President as such, but how Biden will present himself to the jury.
In language acrobatics fitting of both bourgeois imperialist parties in the middle of what they call a “culture war” logical analysis remains absent in their publicity battle for a shrinking field of voters. The Republican mouth pieces among monopoly media, as well as the party itself, were quick to distort Hur’s phrasing as a factual representation of Biden, proclaiming that if he is too senile to remember documents and stand trial, then he is therefore unfit to serve as President. The Democrats and their lackeys, true to the liberal values of playing victim, just cry about the inflammatory language itself and portray the whole thing as unfair discrimination.
Hur’s report does not indicate that Biden actually is so elderly that he cannot remember anything, nor does it conclude innocence to the allegations. Quite the opposite, the report indicates the manner in which the President is likely to present himself to a jury, and concludes that a jury would be sympathetic to this, making it not worth prosecuting. Innocence and guilt in the US justice system is not about whether an individual did it or not, but about whether or not a jury can be convinced. The art of the legal teams is the same as the art of the campaign: a performance to sell a story. It does not matter if the story is true or not. In this pageant innocent people are convicted quite routinely, and guilty people also slide by. This is based far more on popular prejudice among voters than it is among facts and evidence.
The crime itself—retaining classified documents as a civilian—is the same one leveled against Donald Trump, Biden’s only significant competition in the election. Trump is only four years younger than Biden, making both the oldest possible presidents in US history and casting serious doubts on both the Republican senility argument and the Democrat discrimination argument, but propping up the scandal and farce nonetheless. The age of these decrepit imperialist fossils is not irrelevant, the fact that the ruling class parties cannot do better is proof of their own ossification; it is, however a shared indictment.
